What Is Considered Drunk Driving in Nevada?
Nevada has strict laws against drunk and intoxicated driving. Nevada Revised Statutes, Section 484C.110 states that it is unlawful for any person who is under the influence of intoxicating liquor, has a blood alcohol concentration (BAC) level of 0.08 or higher, or is found to have this BAC within two hours of driving to drive or be in actual physical control of a motor vehicle on a public road or highway.
It is also against Nevada’s DUI laws to drive or be in actual physical control of a vehicle while under the influence of a controlled substance or with a prohibited substance in his or her system. However, these limits are only guidelines. It is possible for a driver to be convicted of driving under the influence with a lower BAC if the driver is impaired.
